Causes for Dismissal or Discipline - A.R.S. §41-770

Section 41-770, Arizona Revised Statutes, identifies "cause" for discipline or dismissal of a State employee. In addition to the prohibited conduct listed below, there are other statutes and the ADOA Personnel Rules that govern conduct as a covered employee of the State of Arizona. The following information is provided to inform you of causes for discipline or dismissal of a State Service employee as outlined in A.R.S. Section 41-770.
A. Each of the following constitutes cause for discipline or dismissal of an employee in the State Service:
- Fraud in securing appointment
- Incompetence
- Inefficiency
- Neglect of duty
- Insubordination
- Dishonesty
- Drunkenness on duty
- Addiction to the use of narcotics or habit-forming drugs
- Absence without leave
- Final conviction of a felony or a misdemeanor involving moral turpitude
- Discourteous treatment of the public
- Improper political activity
- Willful disobedience
- Misuse or unauthorized use of state property
B. In addition to the causes prescribed by the terms of subsection A, the Director (of the Department of Administration) may establish other causes deemed necessary.
C. The Director shall prescribe definitions for each of the causes for dismissal or discipline prescribed or established under this section that shall be used by all employees and the Personnel Board in evaluating dismissals and disciplinary actions.
